§1. GENERAL PROVISIONS
1. The online store available at https://shutupandpet.me/ (hereinafter: “Store”) is operated by Dariusz Sawicki, a sole proprietor registered in the Central Register and Information on Economic Activity of the Republic of Poland, Tax Identification Number (NIP): 1181349326, Statistical Number (REGON): 142962000, business address: ul. Solariego 1/414, 02-070 Warsaw, Poland (hereinafter: “Seller”).

3. These Terms and Conditions define the rules for using the Store, placing orders, concluding sales contracts, delivery, payment, withdrawal from the contract, and the complaint procedure.
4. The Store sells and delivers products to customers within the European Union.
5. The products offered in the Store are t-shirts with prints. Products are printed and shipped by the Seller’s print-on-demand fulfillment partner. The Customer is hereby informed that order fulfillment (printing and shipping) is carried out through this partner.
6. Use of the Store requires reading and accepting these Terms and Conditions.
7. These Terms and Conditions are available in English only. In case of any disputes, the English version shall prevail.
§2. DEFINITIONS
The terms used in these Terms and Conditions have the following meanings:
1. Seller – Dariusz Sawicki, a sole proprietor, NIP: 1181349326, REGON: 142962000, ul. Solariego 1/414, 02-070 Warsaw, Poland.
2. Customer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, using the Store.
3. Consumer – a Customer who is a natural person concluding a contract with the Seller that is not directly related to their business or professional activity.
4. Store – the online store operated by the Seller at https://shutupandpet.me/.
5. Product – a movable item available in the Store, being the subject of the Sales Contract between the Customer and the Seller.
6. Sales Contract – a contract for the sale of a Product concluded between the Customer and the Seller through the Store.
7. Order – a declaration of intent by the Customer made through the Store, specifying the type and quantity of Products, aimed at concluding a Sales Contract.
8. Business Day – any day from Monday to Friday, excluding public holidays in Poland.
§3. TECHNICAL REQUIREMENTS
To use the Store, the following are required:
1. A device with Internet access and a web browser (e.g., Chrome, Firefox, Safari, Edge);
2. An active email account;
3. Cookies and JavaScript enabled.
§4. PLACING ORDERS
1. Orders can be placed 24 hours a day, 7 days a week, throughout the year, via the Store’s website.
2. To place an Order, the Customer:
a) selects the Product(s) to be ordered and clicks the “Add to cart” button;
b) proceeds to the cart and selects the delivery method and payment method;
c) provides the information necessary to process the Order (name, surname, delivery address, email address, phone number);
d) accepts the Terms and Conditions of the Store;
e) clicks the “Order and pay” button or equivalent, confirming the Order with an obligation to pay.
3. After placing an Order, the Customer receives an email confirmation that the Order has been accepted for processing. Upon receipt of this confirmation, a Sales Contract is concluded between the Customer and the Seller.
4. The Seller reserves the right to refuse to process an Order in the following cases:
a) suspected fraud (e.g., use of a stolen payment card, inconsistent data);
b) obviously incorrect or incomplete address data, when the Customer does not respond to contact attempts for verification;
c) Product unavailability (e.g., discontinuation of a particular model by the fulfillment partner);
d) an obvious pricing error on the Store’s website;
e) placement of a bulk order without prior arrangement with the Seller.
5. In case of refusal to process an Order for the reasons stated above, the Seller shall immediately inform the Customer and refund all payments made.
§5. PRICES AND PAYMENTS
1. Product prices displayed in the Store are gross prices expressed in euros (EUR) and include all applicable taxes.
2. The Product price does not include delivery costs, which are displayed separately during the Order process and added to the total Order value.
3. The total Order value includes the price of the Products and delivery costs.
4. The Seller accepts the following payment methods: payment cards (Visa, Mastercard, and others), BLIK, PayPal, Apple Pay, and Google Pay.
5. Payments are processed by the payment operator Shopify Payments.
6. The Customer is obliged to make the payment immediately after placing the Order. If payment is not received within 3 days of placing the Order, the Order may be cancelled.
§6. DELIVERY
1. Products are delivered to the address specified by the Customer when placing the Order.
2. The Seller offers delivery via courier service.
3. The delivery cost ranges from 6 to 10 EUR depending on the destination country. The exact delivery cost is displayed during the Order process.
4. The estimated delivery time is 5 to 7 business days from the moment of payment confirmation. This includes the time required for printing the Product by the fulfillment partner and shipping.
5. The delivery times provided are estimates and may be extended for reasons beyond the Seller’s control (e.g., carrier delays, customs procedures).
§7. RIGHT OF WITHDRAWAL
1. A Consumer has the right to withdraw from the Sales Contract without giving any reason within 14 days from the day on which the Consumer or a third party indicated by the Consumer (other than the carrier) takes physical possession of the Product.
2. To exercise the right of withdrawal, the Customer must inform the Seller of the decision to withdraw by means of an unambiguous statement sent to the Seller’s email address or postal address. The withdrawal statement must include:
a) Customer’s full name;
b) Customer’s address;
c) Customer’s email address;
d) Order number;
e) Date of order and date of receipt of the Product;
f) Description of the Product(s) being returned;
g) A clear statement of the decision to withdraw from the contract (e.g., “I hereby withdraw from the contract of sale of the following goods: [description]”);
h) Date and signature (for postal correspondence).
3. To meet the withdrawal deadline, it is sufficient for the Customer to send the withdrawal statement before the deadline expires.
4. In case of withdrawal from the contract, the Customer is obliged to return the Product to the following address: ul. Solariego 1/414, 02-070 Warsaw, Poland, without undue delay and no later than 14 days from the day on which the Customer informed the Seller of the withdrawal.
5. The cost of returning the Product (including shipping costs) shall be borne by the Customer.
6. The Seller shall refund all payments received from the Customer, including the cost of delivery of the Product to the Customer (except for additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay and no later than 14 days from the day of receipt of the returned Product.
7. The refund shall be made using the same payment method as used by the Customer, unless the Customer has expressly agreed to a different method of refund.
8. The Customer shall be liable for any diminished value of the Product resulting from handling it in a way other than what is necessary to establish the nature, characteristics, and functioning of the Product.
9. The Store does not offer size exchanges as a separate procedure. A Customer who wishes to receive a Product in a different size should exercise the right of withdrawal, return the Product, and place a new Order. The Seller recommends carefully reviewing the size chart available on the Store’s website before making a purchase.
§8. COMPLAINTS AND WARRANTY
1. The Seller is obliged to deliver a Product free from defects.
2. If a defect in the Product is found (including print quality defects or damage during transport), the Customer may file a complaint directly with the Seller. Complaints regarding print quality or Product defects are handled by the Seller – the Customer does not need to contact the fulfillment partner directly.
3. Complaints can be submitted electronically to the Seller’s email address or in writing to the Seller’s business address.
4. For complaints regarding damaged Products or packaging, the Customer should report the issue within 30 days of receiving the Product. Reporting within this timeframe enables the Seller to effectively pursue claims with the fulfillment partner and expedites the complaint resolution process.
5. A complaint should include:
a) the Customer’s name and contact details;
b) the Order number;
c) a description of the defect or damage;
d) the Customer’s request (e.g., Product replacement, price reduction, withdrawal from the contract).
6. For complaints regarding damaged Products or packaging, the following must be attached:
a) photographs of the damaged Product;
b) photographs of the external packaging;
c) photographs of the internal packaging (fillers, protective materials).
Providing complete photographic documentation significantly speeds up the complaint resolution process and enables the dispatch of a replacement Product.
7. The Seller shall consider the complaint within 14 days of its receipt and inform the Customer of the outcome.
8. If the complaint is found to be justified, the Seller – according to the Customer’s choice – shall replace the Product with one free from defects, reduce the price, or refund the amount paid for the Product.
9. The provisions of this section do not limit the statutory rights of Consumers under applicable law, including the EU Consumer Rights Directive and national consumer protection laws.
§9. OUT-OF-COURT COMPLAINT RESOLUTION AND REDRESS
1. A Consumer has the option to use out-of-court complaint resolution and redress mechanisms, including:
a) applying to a permanent consumer arbitration court to resolve the dispute;
b) applying to the competent trade inspection authority to initiate mediation proceedings;
c) seeking assistance from a consumer ombudsman or a consumer organization whose statutory tasks include consumer protection.
2. A Consumer may also use the Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr.
3. Detailed information on out-of-court complaint resolution and redress options for Consumers is available on the website of the relevant national consumer protection authority in the Consumer’s country of residence.
§10. PERSONAL DATA PROTECTION
1. The Seller is the controller of Customers’ personal data.
2. Personal data is processed for the purpose of Order fulfillment, handling complaints and returns, and for purposes arising from the Seller’s legitimate interests.
3. Detailed information on the processing of personal data, including Customers’ rights, is contained in the Privacy Policy available on the Store’s website.
§11. APPLICABLE LAW AND JURISDICTION
1. These Terms and Conditions and any Sales Contracts concluded through the Store shall be governed by Polish law.
2. The choice of Polish law does not deprive Consumers of the protection afforded by the mandatory provisions of the law of their country of habitual residence within the European Union.
3. Any disputes arising between the Seller and a Customer who is not a Consumer shall be submitted to the court having jurisdiction over the Seller’s registered office.
4. Consumers may bring proceedings in either the courts of their country of habitual residence or the courts of Poland.
§12. FINAL PROVISIONS
1. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act of 30 May 2014, as well as applicable European Union consumer protection regulations.
2. The Seller reserves the right to amend these Terms and Conditions for important reasons (e.g., changes in legislation, changes in payment or delivery methods). Amendments shall enter into force upon publication on the Store’s website. Orders placed before the amendments enter into force shall be processed under the previous terms.
3. These Terms and Conditions enter into force on 3rd February 2026.
